Terms of Use

1. Purpose

These terms of use ("Terms") govern access to and use of the WyndPath service (the "API", the "Console" and the website), published by Jérémy D. (the "Publisher"). By creating an account or using the service, you accept these Terms without reservation.

2. Definitions

  • Service: the public-data collection API, the management console and the https://www.wyndpath.com website.
  • User: any person holding an account and an API key.
  • Target: the third-party site whose public page the User requests to collect.
  • Credit: the billing unit, charged only on a successful request.

3. Account and access

Access requires creating an account with a valid email address. You are responsible for keeping your API key confidential and for any activity carried out with it. Notify the Publisher without delay at [email protected] in the event of unauthorized use. The Publisher may suspend or close an account in the event of a breach of these Terms.

4. Description of the service

The Service lets you retrieve, through an API call, the content of publicly accessible web pages, handling proxies, JavaScript rendering and the bypassing of technical protections on the User's behalf. The Service is provided "as is", under a best-efforts obligation and not an obligation of result: no success rate is guaranteed on any given target.

5. Authorized and prohibited use

You undertake to use the Service only to collect publicly accessible data, in compliance with applicable law and the rights of third parties. You are solely responsible for the lawfulness of your collections and of the use of the data obtained.

In particular, it is prohibited to use the Service to:

  • access areas protected by authentication without being authorized to do so, or circumvent a security measure within the meaning of the law;
  • collect data in breach of the GDPR (in particular without a legal basis, or sensitive data or data of minors);
  • infringe database rights, copyright, trademarks or the terms of use of a Target where these are binding on you;
  • impair the proper operation of a Target (overload, denial of service);
  • build prospecting or profiling files in breach of the applicable regulations;
  • engage in any fraudulent, malicious or illegal activity.

You undertake to comply with the directives published by Targets (in particular the robots.txt file) and to keep a reasonable pace. The Publisher may refuse or block the collection of certain Targets.

6. Credits and billing

Use of the Service is counted in credits, charged only on success. Pricing and payment terms are set out in the terms of sale and on the Pricing page.

7. Availability

The Publisher strives to keep the Service available, without any guarantee that it will be free of interruption. Maintenance operations or external causes may temporarily affect access.

8. Intellectual property

The Service, its code, its brand and its content remain the property of the Publisher. Data collected through the Service belongs to its respective owners; the Publisher grants you no rights over that data beyond its technical transmission.

9. Liability

The Service is a technical intermediary. The Publisher cannot be held liable for the use you make of the collected data, nor for the consequences of any unlawful collection on your part. To the extent permitted by law, the Publisher's liability is limited to the amounts actually paid by you over the last twelve months.

10. Personal data

The processing of your account data is described in the privacy policy.

11. Termination

You may close your account at any time. The Publisher may suspend or terminate access in the event of a breach of these Terms, in particular section 5.

12. Changes to the Terms

The Publisher may modify these Terms. The applicable version is the one online at the time of your use. Material changes will be notified to you.

13. Governing law

These Terms are governed by French law. Failing an amicable resolution, the French courts have jurisdiction, under the conditions provided by law.
