Terms of Sale

These terms of sale ("Terms of Sale") govern subscriptions to the paid plans of the WyndPath service, published by Jérémy D.. They supplement the terms of use.

As of today, plans are subscribed to without online payment (granted by the publisher). The provisions below will apply once payment is activated.

1. Plans and credits

The Service is offered as monthly plans that include a volume of credits and usage limits (concurrency, etc.). A credit is charged only on a successful request. Plan details appear on the Pricing page, which forms an integral part of these Terms of Sale.

2. Prices

Prices are stated in euros. Whether they are exclusive or inclusive of tax and the applicable VAT rate are shown on the Pricing page and on the invoice. The Publisher may change its prices; the applicable price is the one in force at the time of subscription or renewal.

3. Subscription

Subscription is carried out from the console, after creating an account. By subscribing, you declare that you have the capacity to contract and accept these Terms of Sale. A plan may have a limited number of seats, or be reserved through an activation code.

4. Payment

No online payment is offered as of today: access to plans is granted by the Publisher, or activated by means of a code. Payment terms will be specified here once they are put in place. Where applicable, payment will be made through a secure provider, with the Publisher not retaining your bank card details.

5. Term and renewal

Monthly plans are entered into for a term of one month, renewable by tacit renewal, unless terminated. You may terminate at any time from the console; termination takes effect at the end of the current period. Credits not used at the end of a period are neither carried over nor refunded, unless stated otherwise.

6. Right of withdrawal

In accordance with the French Consumer Code, a consumer is in principle entitled to a period of fourteen (14) days to withdraw. However, since the Service is digital content or a digital service supplied immediately, you are informed that by requesting immediate performance of the service, you expressly waive your right of withdrawal once the service has been fully performed, under the conditions provided by law. This provision does not apply to professionals acting in the course of their business.

7. Performance of the service

Access to the credits and features of the plan is activated as soon as the subscription is confirmed. The Service is provided under a best-efforts obligation; no success rate is guaranteed on any given target.

8. Invoicing

An invoice is issued for each payment and made available in the console or by email. You are responsible for the accuracy of the billing information provided.

9. Complaints

Any complaint may be sent to [email protected]. In the absence of online sales to consumers, no consumer mediator is currently appointed. A mediator will be appointed, in accordance with the regulations, as soon as paid plans are opened to individuals.

10. Liability

The Publisher's liability is exercised within the limits set by the Terms of Use. The Publisher is not responsible for the use of the data collected by the customer.

11. Governing law

These Terms of Sale are governed by French law. Failing an amicable resolution, the competent courts are determined in accordance with the law.
